FOREIGN INVESTMENTS POLICY

The Ministry of Industry has expanded the list of industries eligible for automatic approval of foreign investments and, in certain cases, raised the upper level of foreign ownership from 51 percent to 74 percent and further in certain cases to 100 percent. In January 1998, the RBI announced simplified procedures for automatic FDI approvals. The announcement further provided that Indian companies will no longer require prior clearances from the RBI for inward remittances of foreign exchange or for the issuance of shares to foreign investors.

Facilitating foreign investment

In the recent budget, the finance minister announced the government's commitment to a 90-day period for approving all foreign investments. Government officers will be assigned to larger foreign investment proposals and will facilitate Central and State clearances in a time-bound manner. Unlisted companies with a good 3 year track record, have been permitted to raise funds in international markets through the issue of Global Depository Receipts (GDRs) and American Depository Receipts (ADRs).

A number of recent policy changes have reduced the discriminatory bias against foreign firms.

•    The government has amended exchange control regulations previously applicable to companies with significant foreign participation.

•    The ban against using foreign brand names/trademarks has been lifted.

•    The FY 1994/95 budget reduced the corporate tax rate for foreign companies from 65 percent to 55 percent. The tax rate for domestic companies was lowered to 40 percent.

•    The long-term capital gains rate for foreign companies was lowered to 20 percent; a 30 percent rate applies to domestic companies.

•    The Indian Income Tax Act exempts export earnings from corporate income tax for both Indian and foreign firms.

Other policy changes have been introduced to encourage foreign direct and foreign institutional investment.

For instance, the Securities and Exchange Board of India (SEBI) recently formulated guidelines to facilitate the operations of foreign brokers in India on behalf of registered Foreign Institutional Investors (FII's). These brokers can now open foreign currency-denominated or rupee accounts for crediting inward remittances, commissions and brokerage fees.

Relaxation

The condition of dividend balancing (offsetting the outflow of foreign exchange for dividend payments against export earnings) has been eliminated for all but 22 consumer goods industries. A 5-year tax holiday is extended to enterprises engaged in development of infrastructural facilities. Even without a registered office in India, foreign companies are allowed to start multimodal transport services in India.

The Reserve Bank of India (RBI) now permits 100 percent foreign investment in the construction of roads/bridges. The peak custom duty rate was reduced to 50 percent from 65 percent in the March 1995 budget. Import regime changes included enhancement of the scope of Special Import License (SIL) programs, and the expansion of freely importable items on the Open General License (OGL) list to include some consumer goods.

Dispute Settlement

Currently, there are no investment disputes over expropriation or nationalization. Government demands for penalty payments for alleged overcharging by pharmaceutical companies during the 1980's could lead to de-facto expropriation of some foreign drug companies' assets in India.

In pharmaceutical sector

A committee has been named to study these longstanding disputes, but the failure of successive governments to produce a swift and transparent resolution has led to a virtual standstill in foreign investment in India's pharmaceutical sector. Indian courts provide adequate safeguards for the enforcement of property and contractual rights.

Case backlogs

However, case backlogs frequently lead to long procedural delays. India is not a member

of the International Center for the Settlement of Investment Disputes, nor of the New YorkConvention of 1958. Commercial arbitration or other alternative dispute resolution (ADR) methods are not yet popular ways of commercial dispute settlement in India. The recent introduction in Parliament of a new Arbitration Bill signals the importance now accorded to this matter by the GOI.

And this is the major reason for the Corruption in our Country. Today our teaching system is just completing its formalities. Nothing else? They never thought that what there are teaching is getting inside the students sitting on the first bench as good as the students sitting on the last bench. They never bother about that. They just thought that they have to cover a vast course. Nothing else? Then what a shame for being a teacher as well as the teaching communities.

                                                                                       Let me tell you one that Today we feel shame to follow our culture; we felt that if we follow our culture. It seems so old and others will laugh at us. We just want to look more attractive. Due to this only we are not developing because if we want to develop then first we have to follow our culture. A lot of wonderful things written in our culture but nobody are following that because it is not taught to us in a good manner by our teacher.

                                                                                       Today why America and China is so developed? Why Japan is inventing new things everyday in their country? Because they are following their culture. Their presidents as well as the great leaders uses its mother tongue when they attend a conference and other events. Their culture is taught to them in a good manner and due to this only they uses their power and resources in a good manner that further led to development.

                                                                                       But is it happening in India? Are we following our culture? No, because we thought that we follow it then other will think that we are inferior. And this is not happening in general people only but also with our great leaders as well as leading industrialists. Today Our Honorable Prime Ministers as well as Presidents and many more are using foreign languages to notice any problems and issues in our country instead of our Mother languages.

                                                                                       But I would like to tell you that by adopting foreign culture and we won’t develop ever. Let me focus that, In Europe when Gandhi Ji was asked that which is the most important guide to succeed. He told that “The Gita”. Why he said like that? Because he Knew that a lot of wonderful things written in “Gita”. If we follow it then we will never fail in the life.

                                                                                       But still we are unknown about that. We thought that “Oh Gita is just and Epics”. We never thought that it is about Krishna’s Principles that he told to Arjun’s when he dropped his bows and arrow in the battle field. We never thought that it’s a great principles of life by which we will overcome from various problems if we follows it and further led to development.

                                                                                       At last I want to tell you that if we want to develop then we have to make efforts to develop our teaching system and create awareness among ourselves. Because it’s our life and Nations then why shall we wait for the efforts of our leaders and politicians? Why can’t we make some great efforts such that we can improve the teaching systems as well as helps our next generations to become fully developed and fully educated? And makes our country a wealthy and prosperous as well as economically developed nations like America, China and Japan.

Corrupt Education System

Anand kumar. A well- known teacher of IIT-JEE of Super 30 Brand in Bihar As well as the Brand Ambassdor of Bihar.

He Had done a lot of good works in the education fields. A lot of students had crack out the IIT-JEE exam due to the tremenndous efforts done by him.Due to his great effort in education system, he got a lot of awards and honours not only by the Indian Government but also in Abroad.

                                                                    But in reality, Is h a good n brilliant Teacher? Is the 30 students of his batch crack out the IIT-JEE Exam due to Him?.....No, it's not a Reality. He is just cheating the various students every year on the Name of "SUPER 30". He is using the corrupt policy in education system. 

                                                                    Let me tell you that, Approx 3000 is being taught by Mr.Anand Kumar every year. Why only 30 students crack out the IIT-JEE Exam? Why the rest of students were failed to crack out in IIT-JEE exam? Why Anand Kumar is not providing the name of that 30 Students before the Exam?

                                                                    Not only this. Mr Kumar is a good teacher of Mathematics, not a good as well as the brilliant guider of Physics And Chemistry.

                                                                    And by Mathematics only a student cannot crack out the IIT-JEE exam. For covering the vast course of IIT-JEE, students need a good command in all (Maths.Physics And chemistry). which is not taught by Mr Kumar.

                                                                    Then, Why Mr. Kumar is speaking like that? Why he is speaking that his "Super 30 Students" had cracked out the IIT-JEE exam due to him only? And if it is so...then Why the rest of students failed to crack the IIT-JEE exam. Why only 30 among 3000  students? Why Mr. Kumar is not announcing the name of that 30 students befor the IIT-JEE exam.? Why Success rate is so slow?

                                                                   Let me focus that, Due to his corrupt policy in the education system, A lot of students deviates from his path.They feel shame. They thought that why only 30 students of Mr. Kumar had cracked in the IIT-JEE exam? Why not they? They feel shame to be the students and starts to make some rubbish efforts like suicide and many more which is not expected by their Parents.

                                                                 Why Government is the not taking any action against Mr.Kumar corrupt policy of Education system. Why government is not focusing on that.?

                                                                   Some Days before, In Indore Management Association, Mr. Arindam Chaudhuri, (Honorable Dean of IIPM Think Tank) told that We have to make some great efforts to make our country corruption free and make India fully Educated Country. I am Agree with His Statement...but still why goverment is not taking any action to stop all this things?  Why Indian Government is still Sleeping?

The quest for enlightenment is the quest for truth or reality. It’s not a quest for ideas about truth—that’s philosophy. And it’s not a quest to realize your fantasies about truth—that’s fundamentalized religion. It’s a quest for truth on truth’s terms. It’s a quest for the underlying principle of life, the unifying element of existence.

In your quiet moments of honesty, you know that you are not who you present yourself as, or who you pretend to be. Although you have changed identities many times, and changed them even in the course of a single day, none of them fit for long. They are all in a process of constant decay. One moment you’re a loving person, the next an angry one. One day you’re an indulgent, worldly person; the next a pure, spiritual lover of God. One moment you love your image of yourself, and the next you loathe it. On it goes, identified with one self-image after another, each as separate and false as the last.

When this game of delusion gets boring or painful enough, something within you begins to stir. Out of the unsatisfactoriness of separation arises the intuition that there is something more real than you are now conscious of. It is the intuition that there is truth, although you do not know what it is. But you know, you intuit, that truth exists, truth that has absolutely nothing to do with your ideas about it. But somehow you know that the truth about you and all of life exists.

Once you receive this intuition, this revelation, you will be compelled to find it. You will have no choice in the matter. You will have consciously begun the authentic quest for enlightenment, and there is no turning back. Life as you’ve known it will never be quite the same.

A great Zen master said, “Do not seek the truth; simply cease cherishing illusions.” If there is a primary practice or path to enlightenment, this is it—to cease cherishing illusions. Seeking truth can be a game, complete with a new identity as a truth-seeker fueled by new ideas and beliefs. But ceasing to cherish illusions is no game; it’s a gritty and intimate form of deconstructing yourself down to nothing. Get rid of all of your illusions and what’s left is the truth. You don’t find truth as much as you stumble upon it when you have cast away your illusions.

As the master said, “Do not seek the truth.” But you can’t stop seeking just because some ancient Zen master said to. Seeking is an energy, a movement toward something. Spiritual seekers are moving toward God, nirvana, enlightenment, ultimate truth, whatever. To seek something, you must have at least some vague idea or image of what it is you are seeking. But ultimate truth is not an idea or an image or something attained anew. So, to seek truth as something objective is a waste of time and energy. Truth can’t be found by seeking it, simply because truth is what you are. Seeking what you are is as silly as your shoes looking for their soles by walking in circles. What is the path that will lead your shoes to their soles? That’s why the Zen master said, “Do not seek the truth.” Instead, cease cherishing illusions.

To cease cherishing illusions is a way of inverting the energy of seeking. The energy of seeking will be there in one form or another until you wake up from the dream state. You can’t just get rid of it. You need to learn how to invert it and use the energy to deconstruct the illusions that hold your consciousness in the dream state. This sounds relatively simple, but the consequences can seem quite disorienting, even threatening. I’m not talking about a new spiritual technique here; I’m talking about a radically different orientation to the whole of your spiritual life. This is not a little thing. It is a very big thing, and your best chance of awakening depends on it. “Do not seek the truth; simply cease cherishing illusions.” And if you’re like most spiritually oriented people, your spirituality is your most cherished illusion. Imagine that.
